A CHARTER ORDINANCE EXEMPTING THE CITY OF AUBURN, KANSAS FROM K.S.A. 1974 SUPP. 15-209; PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT AND REMOVING ANY LIMITATIONS OF RESIDENCY REQUIREMENTS.
Section 1. The City of Auburn, Kansas, a city of the third class, by the power vested in it by Article 12, Section 5, of the constitution of the State of Kansas, hereby elects to exempt itself from, and make applicable to it K.S.A. 1974 Supp. 15-209 and provide substitute and additional provisions as hereinafter set forth in this ordinance. K.S.A. 1974 Supp. 15-209 is applicable to this city but is not applicable uniformly to all cities of the third class, and the legislature has not established classes of cities for the purpose of imposing residency requirements under said constitutional provisions.
Section 2. The governing body of the City of Auburn, Kansas, shall be qualified electors of said city; however, all other appointed officers need not be residents of the City of Auburn, Kansas; that all other provisions of K.S.A. 1974 Supp. 15-209 shall remain in full force and effect.
