A CHARTER ORDINANCE EXEMPTING THE CITY OF AUBURN, KANSAS FROM THE PROVISIONS OF K.S.A. 41-712 PROHIBITING ALCOHOLIC LIQUOR SALES ON SUNDAY AND CERTAIN HOLIDAYS.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF AUBURN, KANSAS:

SECTION 1. The City of Auburn, Kansas by the power invested in it by Article XII, Section 5 of the Constitution of the State of Kansas hereby exempts itself from and makes inapplicable to it K.S.A. 41-712, a legislative enactment which is applicable to the City of Auburn, Kansas, but is not applicable uniformly to all cities in the State of Kansas.

SECTION 2. The governing body of the City of Auburn, Kansas shall establish hours for the sale at retail of alcoholic liquor on Sundays by ordinary ordinance. The governing body of the City of Auburn, Kansas shall prohibit or allow the sale at retail of alcoholic liquor on certain other days including holidays by ordinary ordinance.

SECTION 3. This ordinance shall take effect and be in force from and after its publication in the official city newspaper once each week for two consecutive weeks and after the passage of a sixty (60) day waiting period after the first publication if no protest petition filed by ten (10%) percent of those who voted in the last regular city election is filed.
