ARTICLE 1. CITY PLANNING COMMISSION/BOARD OF ZONING APPEALS

The members of the city planning commission shall be appointed by the mayor with the consent of the council. The members of the planning commission shall be appointed for terms of three years each. Vacancies shall be filled by appointment for the unexpired term only. Members of the planning commission shall serve without compensation.

The members of the planning commission shall meet at least once a month at such time and place as they fix by resolution. They shall select one of their number as chairperson and as vice chairperson who shall serve one year and until their successor has been selected. They shall annually appoint a secretary who may be an officer or employee of the city. Special meetings may be called at any time by the chairperson or in his or her absence by the vice chairperson. A majority of the planning commission shall constitute a quorum for the transaction of business. The planning commission shall cause a proper record to be kept of its proceedings.

The planning commission and city governing body shall have all the powers and duties set forth in the Kansas Statutes Annotated and as may be amended in the future.

The Auburn City Planning Commission shall serve as the City's Board of Zoning Appeals as allowed by K.S.A.§ 12-759(g). All matters designated by City Code, Ordinance or Kansas law to be heard by a Board of Zoning Appeals shall be heard by the Auburn City Planning Commission, in the manner outlined in this Article.

The governing body shall approve a budget for the planning commission and make such allowances to the commission as it deems proper, including funds for the employment of such employees or consultants as the governing body may authorize and provide, and shall add the same to the general budget. Prior to the time that moneys are available under the budget, the governing body may appropriate moneys for such purposes from the general fund. The governing body may enter into such contracts as it deems necessary and may receive and expend funds and moneys from the state or federal government or from any other resource for such purposes.

The governing body of the City hereby approves the recommendations of the City Planning Commission and adopts the City of Auburn, Kansas 2001 Comprehensive Plan and amendments thereto recommended by the City Planning Commission.
